Welcome to Shelter Skin, LLC (“Shelter Skin,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, www.shelterskin.com, and any related services, content, functionality, and products (collectively, the “Services”). By accessing, browsing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, please refrain from using our Services.

1. Eligibility
   You must be at least the age of majority in your jurisdiction to use our Services. By using the Services, you represent and warrant that you meet this eligibility requirement. If you do not meet this requirement, please do not use our Services.

2. Use of Our Services
   a. Personal, Non-Commercial Use: The Services are intended for your personal, non-commercial use only. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services without express written permission from Shelter Skin.
   b. Compliance with Laws: You agree to use the Services in accordance with all applicable laws, regulations, and guidelines.
   c. Accuracy of Information: You agree to provide accurate, current, and complete information when prompted and to update this information as necessary.

3. Product Information and Purchases
   a. Product Descriptions: We strive to provide accurate and detailed information about our skincare products. However, Shelter Skin does not guarantee that product descriptions, images, or other content on the Services are error-free, complete, or current.
   b. Pricing and Availability: Prices and availability of products are subject to change without notice. Shelter Skin reserves the right to limit quantities of any product and to refuse any order for any reason.
   c. Order Acceptance: Your receipt of an order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right to refuse service to anyone for any reason at any time.

4. Refunds and Returns
   Please refer to our separate Refund and Return Policy on the Shipping & Returns page for information on returns, exchanges, and refunds of purchased products.

5. Intellectual Property Rights
   a. Ownership: All content on the Services, including but not limited to text, graphics, logos, images, product designs, and software, is owned by or licensed to Shelter Skin and is protected by intellectual property laws.
   b. License to Use: We grant you a limited, revocable, non-transferable, and non-exclusive license to access and use the Services solely for your personal, non-commercial purposes.
   c. Restrictions: You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our intellectual property except as expressly authorized by these Terms.

6. User-Generated Content
   If you submit or post any content (such as reviews, comments, photographs) on or through our Services (“User Content”), you grant Shelter Skin a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, and fully sub-licensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media. You represent and warrant that you own or control all rights to your User Content, and that our use of your User Content will not violate any third party’s rights.

7. Disclaimer of Warranties
   THE SERVICES AND ALL PRODUCTS AND CONTENT PROVIDED THROUGH THEM ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. SHELTER SKIN DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability
   TO THE FULLEST EXTENT PERMITTED BY LAW, SHELTER SKIN, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF SHELTER SKIN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Indemnification
   You agree to indemnify, defend, and hold harmless Shelter Skin, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Services.

10. Governing Law and Dispute Resolution
    These Terms and any dispute arising out of or related to them or the Services shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the Services shall be instituted exclusively in the federal or state courts located in the United States, Texas. You waive any objections to venue in such courts.

11. Changes to the Terms
    We reserve the right to modify or replace these Terms at any time. Any changes will be effective immediately upon posting to the Services. Your continued use of the Services following the posting of revised Terms indicates your acceptance of the changes.

12. Severability and Waiver
    If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

13. Entire Agreement
    These Terms and our Privacy Policy constitute the entire agreement between you and Shelter Skin regarding the Services and supersede all prior and contemporaneous agreements, understandings, and representations.

15. Mobile Terms of ServiceShelter Skin

    The Shelter Skin mobile message service (the "Service") is operated by shelter skin (“Shelter Skin”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

    By consenting to Shelter Skin’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Shelter Skin through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

    You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Shelter Skin. Your participation in this program is completely voluntary.

    We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

    You may opt-out of the Service at any time. Text the single keyword command STOP to +18885927047 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Shelter Skin mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

    We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

    The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

    To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
